The terms on which you may use POPS Notebook

1. Definitions

"Application" means the POPS Notebook mobile web application and all associated services.

"Force" means a UK police force that has purchased an enterprise license.

"Individual License" means a personal subscription purchased by an individual officer.

"Force Enterprise License" means a bulk license purchased by a force for its officers.

"We", "us", "our" refers to POPS Notebook, Inc.

"You", "your" refers to the individual user of the Application.

2. Service Description

POPS Notebook is an offline-first digital tactical reference and operational support tool for UK Public Order and Public Safety officers. It provides legislative reference, tactical playbooks, ephemeral local-only operational tools, encrypted officer profiles, force broadcast messaging, and a real-time classroom training sandbox.

The Application is designed to operate entirely offline once loaded. Operational data is stored locally on the device and is never synchronised to a cloud database. The Application does not process, store, or transmit information classified above OFFICIAL.

3. Eligibility and Account Registration

You must be a serving UK police officer, police staff member, or authorised contractor to use the Application. You must register using a personal email address for authentication; your force-issued email is used only for operational status verification.

You must provide accurate and complete information during registration and keep it up to date. You are responsible for maintaining the security of your account credentials.

Registration requires you to accept this Acceptable Use Policy and Privacy Statement as a mandatory step in the sign-up process.

4. Licence to Use

Subject to your compliance with these Terms and your applicable AUP, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Application for the duration of your active subscription or force enterprise license.

This licence does not include any right to sub-license, transfer, or resell access to the Application.

5. Acceptable Use

Your use of the Application is governed by our Acceptable Use Policy, which forms part of these Terms. You must comply with the AUP at all times. Key obligations include the Zero-Export Rule, the 24-hour data ephemerality requirement, and the incident reporting duty.

We reserve the right to suspend or terminate access immediately if we have reasonable grounds to believe you have breached the AUP.

6. Subscription and Payment

Individual officers may purchase an Individual License at the published annual rate. Payment is processed securely through Stripe. Your subscription auto-renews annually unless cancelled through the Customer Portal.

If your force subsequently purchases a Force Enterprise License that covers you, your individual subscription will be automatically cancelled and a pro-rata refund issued for the unused portion of your subscription period.

All prices are inclusive of applicable VAT where required. Refunds are issued at our discretion in accordance with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

7. Force Enterprise Licensing

Forces may purchase a Force Enterprise License providing bulk access for a specified number of officers. Enterprise licenses include an admin console for user management, role assignment, feature toggles, force guidance publication, and audit log export.

Force Enterprise Licences are granted on an annual basis. The force is the Data Controller for all operational data created by its officers. POPS Notebook acts as Data Processor.

Optional add-ons, including the Command Broadcast module, may be purchased separately and activated by the force admin.

8. Intellectual Property

The Application, including its design, source code, tactical doctrine content, and branding, is the intellectual property of POPS Notebook, Inc. and is protected by UK and international copyright and trademark law.

Tactical doctrine content is derived from publicly available College of Policing Authorised Professional Practice (APP) and NPCC guidance. Forces may add local guidance through the admin console; such content remains the intellectual property of the force.

You must not copy, modify, distribute, or reverse-engineer any part of the Application without our prior written consent.

9. Limitation of Liability

The Application is provided as an operational support tool and does not replace professional judgement, force policy, or legal advice. We accept no liability for operational decisions made by officers using the Application.

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Application shall not exceed the amount you have paid for your subscription in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential damages, including loss of operational data from ephemeral cache, device failure, or force-imposed access restrictions.

10. Indemnification

You agree to indemnify and hold harmless POPS Notebook, Inc., its officers, directors, and employees from any claim, loss, or damage arising from your breach of these Terms, the AUP, or your misuse of the Application.

11. Termination

You may terminate your account at any time through the Application's Settings page. Upon termination, all local caches expire within 24 hours and your account data is permanently deleted from the database.

We may suspend or terminate access immediately if you breach these Terms or the AUP, if your force suspends or terminates its enterprise license, or if we are required to do so by law.

Upon termination by your force, your account is suspended and all force-scoped data access is revoked immediately. Local caches expire within 24 hours.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
